TERMS AND CONDITIONS

Definitions

“The Company” means Hanco Heating Ltd.

“The Customer” means the person, household, business or organisation instructing the Company to carry out work or supply materials.

Quotations and Estimates

All written quotations are valid for 30 days unless otherwise stated.

Quotations are based on information available at the time of inspection. If additional work or materials are required that could not reasonably have been identified beforehand, the Company reserves the right to amend the quotation after discussing the matter with the Customer.

Verbal estimates are provided for guidance only and are not binding.

Charges

The Customer agrees to pay the agreed quotation or, where no fixed quotation has been provided, the Company’s current labour and material rates.

Materials supplied by the Company may include a reasonable handling charge.

Any additional work requested by the Customer that falls outside the original quotation will be charged separately.

All charges are subject to VAT where applicable.

Payment Terms

Payment is due immediately upon completion of the work unless otherwise agreed in writing.

The Company reserves the right to charge interest on overdue accounts in accordance with applicable legislation.

Ownership of any goods supplied shall remain with the Company until payment has been received in full.

Appointments and Cancellations

The Customer shall provide safe and reasonable access to the property, appliance and associated systems.

The Company reserves the right to charge for missed appointments, failed access visits or cancellations made with less than 24 hours notice.

Workmanship Guarantee

The Company guarantees its workmanship for a period of 12 months from the date of completion, provided payment has been made in full.

This guarantee applies only to defects arising directly from the Company’s workmanship.

Manufacturer warranties remain subject to the manufacturer’s own terms and conditions.

Exclusions from Guarantee

The guarantee shall not apply where:

a) The appliance or system has been misused, neglected, damaged or improperly maintained.

b) Repairs, alterations or adjustments have been carried out by anyone other than the Company.

c) Existing faults or defects unrelated to the Company’s work subsequently become apparent.

d) Recommended remedial work has not been carried out.

e) The appliance or system is obsolete, beyond economic repair or in poor condition.

The Company does not guarantee the clearance of drain, waste or sewer blockages beyond completion of the initial work.

Existing Systems

The Company cannot accept responsibility for pre-existing faults, leaks, corrosion, sludge, scale, component failures or other defects that may become apparent during or after work on existing systems.

The Company shall not be responsible for existing defects or failures that become apparent during servicing, repair or maintenance work.

Customer Supplied Materials

The Company accepts no responsibility for the quality, suitability, compatibility or performance of any materials, equipment or components supplied by the Customer.

Gas, Oil and Heating Installations

Where the Company identifies a potentially unsafe condition affecting a gas, oil, heating or plumbing installation, the Customer shall be advised accordingly.

The Customer remains responsible for acting upon any safety advice, warning notice or recommendation provided by the Company.

Limitation of Liability

The Company’s liability shall be limited to the cost of rectifying defects in work carried out by the Company.

The Company shall not be liable for indirect, consequential or financial losses arising from defects, delays or equipment failure.

Nothing in these terms shall exclude or limit liability that cannot legally be excluded under the laws of England and Wales.

Delays Beyond Our Control

The Company shall not be liable for delays caused by weather conditions, traffic delays, supplier shortages, equipment breakdowns, illness or any other circumstances beyond its reasonable control.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.
